Supermarket Tesco is suing clothing chain Matalan Retail in a dispute over the lease of a Plymouth shop.
Tesco claims it is entitled to forfeit the lease of the shop in Transit Way, Plymouth, on the grounds that its tenant, Matalan, has kept the store closed since April this year.
Tesco served Matalan with a notice under the Law of Property Act 1925, specifying the breach of covenant complained of and asked Matalan to remedy the breach, but Matalan has allegedly failed to comply with the notice.
The shop was let to Matalan for 25 years from September 1995, and the current rent is £210,000 pa. A rent review is due in September, when Tesco proposes a new rent of £392,500 pa.
Tesco is seeking possession of the premises, damages for breach of covenant, and mesne profits of £575.34 a day until possession.
