LISTEN Herbert Smith Freehills partners join Jess Harrold to discuss the firm’s new report – Forearmed: a real estate disputes guide to likely trends in 2021 and beyond.
Head of real estate dispute resolution Matthew Bonye, head of planning Matthew White and, from the restructuring/insolvency team, John Chetwood, each address key points raised in the report, which sets out HSF’s predictions as to where disputes are likely to arise, providing a “roadmap to preparing for the coming months”.
Bonye, White and Chetwood address major real estate battlegrounds arising out of the pandemic, how its long-term effects will impact the way we live and work, and the changing property needs that will result.
The discussion covers such landlord and tenant issues as unpaid rent, forfeiture, dilapidations and the position of lease guarantors; planning matters arising out of evolving priorities and changes to the system, including more permitted development rights; and questions of tenant insolvency and CVAs.
