Introduction1. This judgment follows the trial of revised preliminary issues in an action in which the claimants seek declarations that there was no contract, alternatively no enforceable contract, alternatively rescission of any contract, for the purchase of a 999 year lease of a hotel room at the Park Plaza Westminster Bridge Hotel, and the refund of deposits paid by them to the defendant; the defendant counterclaims for declarations that there were valid and binding contracts and that the deposits have been forfeited, and for damages.2.
