Neo Bankside sues façade engineering consultancy for professional negligence

 The management company of exclusive Thames-side development Neo Bankside is suing the specialist façade engineering consultancy that advised on the building’s construction.

The claim was filed against Wintech Ltd in the High Court yesterday. It was filed by Neo Bankside Management Company Ltd as a so called “part 7” claim for professional negligence. 

After years of litigation, the residents of the building won a high-profile nuisance case brought against neighbour Tate Modern over a viewing platform that the gallery opened to the public in 2016.

The residents argued the platform was a “nuisance” in law as the it allowed thousands of members of the public to peer into their apartments. 

They lost their case in the High Court when the judge found that the overlooking could in theory constitute a nuisance, but dismissed the residents’ claim, finding the building created a “self-induced incentive to gaze”.

Wintech, on its website, described the building as “visually striking” with “a unique external structural bracing and a façade comprised of timber and clear glazing”.

The residents pursued their case to the Supreme Court. They won their case in February last year and have since come to an agreement with the gallery. 

According to Wintech’s website, it “provided comprehensive façade engineering consultancy services on this remarkable project, assisting in the successful formation of the unique building skins that exhibit the structure on the outside”. 

A spokesperson for Wintech said in a statement that the company “will strongly defend the claim.”

“Wintech has done nothing wrong,” the spokesperson said.
